Overview

Tower Climbing Grease Monkeys, also known as TCGM, LLC ("TCGM," "we," "us," or "our"), respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect Personal Information when you visit tcgm.com, shop with us, create an account, contact us, sign up for email or text messages, submit a job listing or site-stop request, enter a giveaway, attend or interact with a TCGM event, or otherwise use our products, content, forms, and services (collectively, the "Service").

"Personal Information" means information that identifies, relates to, describes, or can reasonably be linked with an individual or household. It does not include information that has been deidentified or aggregated so that it cannot reasonably identify you.

By using the Service, you acknowledge the practices described in this Privacy Policy. If you do not agree with this policy, please do not use the Service or provide Personal Information to us.

Personal Information We Collect

The information we collect depends on how you interact with TCGM.

Information You Provide Directly

We may collect:

  • Contact information, such as your name, email address, phone number, mailing address, company, job title, and social-media handle.

  • Account information, such as login credentials, profile details, preferences, and account activity.

  • Order and transaction information, such as products purchased, billing and shipping details, order history, returns, and customer-service communications. Payment-card information is processed by Shopify and applicable payment providers. TCGM does not generally receive or store full payment-card numbers.

  • Marketing preferences, including your email subscription choices, SMS opt-in status, consent records, unsubscribe or opt-out requests, and interactions with messages we send.

  • Tour, event, and site-stop information, such as your site or company name, location, crew information, availability, contact details, and other information submitted through a tour or hosting form.

  • Job and recruitment information, such as employer or recruiter details, job-listing content, applicant information, resumes, work history, qualifications, or other information submitted through our recruitment-related services.

  • Giveaway and promotion information, such as contact details, eligibility confirmations, entries, responses, and information needed to verify or deliver a prize. Separate Official Rules may apply.

  • Content and submissions, such as reviews, comments, photographs, videos, testimonials, survey responses, feedback, and other material you choose to provide. At in-person events, we may also collect photographs, video, or audio when notice is provided or permission is obtained as appropriate.

  • Customer-support information, including the content of emails, messages, calls, forms, or other communications with us.

Please do not send us sensitive information that we have not requested.

Information Collected Automatically

When you use the Service, we and our service providers may automatically collect:

  • Device and browser type, operating system, IP address, general location derived from IP address, language, and time zone;

  • Pages, products, links, and content viewed; searches; referring and exit pages; dates and times of visits; and other browsing activity;

  • Shopping-cart, checkout, purchase, and account activity;

  • Cookie identifiers, pixels, tags, software-development kits, and similar technology data;

  • Email and SMS delivery, open, click, reply, and opt-out information, where available; and

  • Information used to maintain the Service, remember preferences, measure performance, prevent fraud, and protect security.

Information From Other Sources

We may receive Personal Information from:

  • Shopify and payment, fulfillment, shipping, point-of-sale, and e-commerce providers;

  • Mailchimp and other email, SMS, customer-relationship, or communications providers;

  • Analytics, advertising, and social-media platforms;

  • Employers, recruiters, sponsors, tour hosts, event organizers, and business partners;

  • People who refer you, invite you, purchase something for you, or submit information with your authorization; and

  • Publicly available sources, where permitted by law.

If you apply for a job or interact with an employer through a linked third-party website, that third party's privacy policy applies to the information collected on its site.

How We Use Personal Information

We may use Personal Information to:

  • Operate, maintain, personalize, and improve the Service;

  • Create and manage accounts;

  • Process payments, orders, returns, exchanges, shipping, fulfillment, and point-of-sale transactions;

  • Provide customer service and respond to questions, requests, or complaints;

  • Manage the TCGM Tech Tour, site-stop requests, events, demonstrations, community activities, and related communications;

  • Publish and manage job listings, recruitment placements, and related inquiries;

  • Administer giveaways, contests, and promotions, including verifying eligibility, contacting potential winners, and delivering prizes;

  • Send transactional or service-related messages about accounts, orders, events, entries, forms, security, and policy changes;

  • Send email or SMS marketing when you have provided the consent required by law;

  • Understand how people use the Service, measure campaign performance, and improve our products, content, events, and communications;

  • Display, measure, and improve advertising, subject to applicable consent and opt-out rights;

  • Detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity;

  • Enforce our agreements and protect the rights, property, safety, and integrity of TCGM, our community, our users, and others;

  • Meet legal, tax, accounting, recordkeeping, and regulatory obligations; and

  • Carry out another purpose disclosed to you when the information is collected or with your consent.

Email and SMS Communications

Email

If you subscribe to TCGM email marketing, we may send newsletters, Tech Tour updates, job alerts, giveaway reminders, merchandise news, community updates, and other offers. You may unsubscribe through the link in any marketing email. We may still send non-marketing messages that are necessary for an order, account, entry, request, or other transaction.

SMS Program

If you separately opt in to the Tower Climbing Grease Monkeys Mobile Messaging Program, we may collect your mobile number, consent date and source, message and interaction information, device or carrier information, and opt-out records. We use this information to send and manage recurring informational and promotional text messages, which may include Tech Tour announcements, route and event updates, site-stop information, giveaway reminders, merchandise updates, job-posting alerts, community news, and other TCGM offers or updates.

Email consent and SMS consent are separate. Providing an email address does not authorize marketing text messages, and providing a mobile number for an order, form, event, or customer-service request does not by itself enroll you in the SMS Program. Consent to marketing texts is not a condition of purchase.

We may disclose SMS-related information to Mailchimp and to messaging-platform, telecommunications, carrier, hosting, and technical service providers only as needed to operate, maintain, secure, and support the SMS Program, comply with law, and honor your choices. Personal Information collected through the SMS Program, including mobile numbers, opt-in data, and consent records, will not be sold, rented, or shared with affiliated or unaffiliated third parties for their own marketing or promotional purposes.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. We may retain consent and opt-out records as needed to document and honor your communication choices. For full program terms, review our Terms of Service.

How We Disclose Personal Information

We may disclose Personal Information in the following circumstances:

  • Service providers. We use companies that help with e-commerce, website hosting, payment processing, fraud prevention, shipping, fulfillment, point of sale, customer support, email, SMS, analytics, advertising, cloud storage, event operations, and professional services. These providers may use information only to perform services for us or as otherwise permitted by their agreements and applicable law.

  • Shopify. Shopify powers our online store and processes information as described in its Consumer Privacy Policy.

  • Business and community partners. We may disclose information to tour hosts, event organizers, employers, recruiters, sponsors, giveaway providers, and other partners when needed to provide a requested service, administer an event or promotion, or carry out a purpose disclosed to you. We do not give these parties your mobile opt-in information for their own marketing.

  • Advertising and analytics partners. Subject to your privacy choices and applicable law, we may allow analytics, social-media, or advertising providers to collect information through cookies or similar technologies to measure activity, understand audiences, or show relevant advertising.

  • Legal and safety purposes. We may disclose information when we reasonably believe it is required by law, legal process, or a government request, or when needed to investigate fraud, enforce agreements, protect rights and safety, or respond to an emergency.

  • Business transactions. Information may be disclosed as part of a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to applicable law.

  • With your direction or consent. We may disclose information when you ask us to or authorize us to do so.

We may use and disclose aggregated or deidentified information for any lawful purpose. We will not attempt to reidentify deidentified information except as permitted by law.

Targeted Advertising, Sale, and Sharing

TCGM does not sell Personal Information for money. Some privacy laws define "sale," "sharing," or "targeted advertising" broadly enough to include certain uses of cookies, pixels, advertising services, or cross-context behavioral advertising. Depending on the tools enabled on the Service, those activities may fall within these definitions.

Where applicable, you may opt out through the cookie or privacy controls available on the Site, through a "Do Not Sell or Share My Personal Information" or data-sharing opt-out link if displayed, or by contacting us at tcgm@tcgm.us. We also recognize legally required browser-based opt-out preference signals, such as Global Privacy Control, when required by applicable law.

We do not knowingly sell or share the Personal Information of individuals under 16 for targeted advertising.

Cookies and Similar Technologies

TCGM, Shopify, and our service providers use cookies, pixels, tags, local storage, and similar technologies to:

  • Keep the Site and checkout functioning;

  • Remember settings, carts, and preferences;

  • Maintain accounts and security;

  • Understand traffic and performance;

  • Measure emails, campaigns, and advertisements; and

  • Personalize content or advertising where permitted.

Some cookies are necessary for the Service to work. Others may be controlled through our cookie banner or privacy settings where available. You can also block or delete cookies through your browser, but doing so may cause parts of the Site, cart, checkout, or account features to stop working correctly.

The cookies used by Shopify may change as its services evolve. For current information, review Shopify's Cookie Policy. Your browser may also offer a Global Privacy Control setting as described above.

Data Retention

We retain Personal Information for as long as reasonably necessary for the purposes described in this policy, including to provide the Service, complete transactions, maintain business and consent records, administer promotions, resolve disputes, prevent fraud, enforce agreements, and meet legal, tax, accounting, or regulatory obligations.

Retention periods vary based on the type of information, our relationship with you, legal requirements, operational needs, and whether the information is needed to protect rights or safety. When information is no longer reasonably needed, we may delete, anonymize, or securely dispose of it, subject to technical and legal limitations.

Security

We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information. No website, network, transmission, or storage system is completely secure, so we cannot guarantee absolute security. You are responsible for protecting your account credentials and for notifying us if you believe your account or information has been compromised.

International Processing

TCGM is based in the United States. Shopify, Mailchimp, and other providers may process Personal Information in the United States, Canada, and other countries where they or their service providers operate. Those countries may have different privacy laws from the place where you live. Where required, we use or rely on legally recognized safeguards for international transfers.

Your Privacy Rights and Choices

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • Confirm whether we process your Personal Information;

  • Request access to or a copy of Personal Information we hold about you;

  • Request correction of inaccurate Personal Information;

  • Request deletion of Personal Information;

  • Request a portable copy of certain information;

  • Opt out of the sale or sharing of Personal Information, targeted advertising, or certain profiling;

  • Limit certain uses or disclosures of sensitive Personal Information;

  • Withdraw consent where processing is based on consent; and

  • Appeal a decision we make about a privacy request, where applicable.

To make a request, email tcgm@tcgm.us and write Privacy Request in the subject line. Tell us the right you want to exercise and provide enough information for us to locate your records. We may need to verify your identity and authority before completing a request. We will use information submitted for verification only to evaluate and respond to the request.

Where permitted, an authorized agent may submit a request for you. We may ask for proof of the agent's authority and may need to verify your identity directly. If we deny a request, you may appeal by replying to our decision or emailing us with Privacy Appeal in the subject line.

We will not discriminate against you for exercising an applicable privacy right. We may retain information needed to document and honor an opt-out or deletion request.

EEA, United Kingdom, and Switzerland

Where the General Data Protection Regulation, United Kingdom data-protection law, or similar law applies, our legal bases for processing may include performance of a contract, compliance with legal obligations, your consent, and our legitimate interests in operating, securing, improving, and communicating about the Service when those interests are not overridden by your rights.

You may also object to or request restriction of certain processing and lodge a complaint with the data-protection authority where you live. If you withdraw consent, the withdrawal will not affect processing already completed lawfully before the withdrawal.

Children

The Service is not directed to children under 13, and we do not knowingly collect Personal Information from children under 13. If you are a parent or guardian and believe a child has provided Personal Information to us, contact us so we can review and, where appropriate, delete it.

Giveaways, purchases, events, job services, and other parts of the Service may have higher age requirements stated in the applicable terms or rules.

Third-Party Sites and Services

The Service may link to websites, forms, job boards, social-media platforms, sponsors, employers, or other services that TCGM does not control. This Privacy Policy does not apply to those third parties. Review their privacy policies before providing information.

Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to the Service, our practices, technology, or legal requirements. We will post the revised policy on this page and update the date above. When required by law, we will provide additional notice or request renewed consent.
